Stop Sign Tickets

Disobeying a stop sign in New York state is a serious violation.  This is no surprise given the potential risks to public safety.  Unfortunately, everyone has probably done it at least once in their lifetime.  It usually happens because you either did not see the stop sign or you slowly rolled through it without coming to a complete stop.  Pleading guilty or being convicted of this violation can be quite costly.

Disobeying A Stop Sign - VTL 1172(a)

New York VTL 1172(a) requires a motorist to stop when approaching a stop sign.  More specifically, the motorist is required to stop at:

  • A clearly marked stop line.  If there is no stop line, then
  • Before entering the crosswalk.  If there is no crosswalk, then
  • Before entering the intersection

The right to proceed after stopping is governed by VTL 1142.  After stopping the motorist must yield to any vehicle which has entered the intersection or any vehicle which is approaching so closely as to constitute an immediate hazard.

The penalties for violating 1172(a) are costly.  The penalties increase with multiple failure to stop violations in any 18 month period.  A first offense will cost you:

  • 3 points on your license
  • A fine of up to $150
  • Court surcharge of $93
  • Up to 15 days in jail

A second failure to stop conviction within 18 months of the first will cost you:

  • 3 points on your license

  • Up to 45 days in jail

A third failure to stop conviction within 18 months of the first will cost you:

  • 3 points on your license
  • A fine of up to $450
  • Court surcharge of $93
  • Up to 90 days in jail
